Ogre Heritage Crate is available now. But if you're on a TLP check carefully to be sure that some of the better things (mounts) are available. I bought a crate today and all I got was a crummy set of armor decorations. Most of what's available in the crate is not available to me.
You'll still get the items, they just won't be useable until the proper expansion. It's not like they're removed from the crate item table.
