    Daybreak End User License Agreement” are just only for .... yeah "Daybreak".
    Here in Germany is the law that any agreements, that aren´t similar to GERMAN law are not responsible for us.
    If a discounter, Shop, Internetshop makes a price, price is set to sell, and if they make a mistake in setting the price it´s their fault not yours. So if I buy a car for 1¼ € and the dealer says " Oh no I ment 11400€ and not 1¼ it is his fault and maybe I get a lawyer who will give me right.

    But btt.: If I would have seen a package in the marketplace which is highly under priced I would ask myself if it could be a fault by DB and maybe would ask in the forum or @ support if it´s okay so or not.

    not really sure where you're going with this. fun thread. drama.

    basically (at least in the US) if an item is marked wrong at no point in time is anyone obligated to adhere to said price. "prices are subject to change" is in the fine print of all sale filters. its not even a slippery slope and there are tons of things you can google up to support this and all its nuance.

    if you're going to do something bad you should be prepared to pay the consequences if and when you get caught.

    And therefore the whole argument is subjective. We have very little information..other than a group of people got banned. We do not know if or any wrongdoing to any extent was involved. Only the Devs do, and it appears it was corrected according to Mepps.

    We can go about quoting language used by businesses that should not be abused or used without good cause by the way, just as much as we can quote consumer laws to contradict leaving the quotations open for ridicule. But, I am sure we do not want to fill the thread and forum board with that do we?

    Just because a bicycle in in a front yard unchained does not mean that it's free for the taking and you understand that. You Sir are a good person with good moral standards. That's how the majority of people are & it should be. But, as you should know from life's experiences. Some people have low moral standards and would rather lie, cheat & steal. These people you can catch them red handed and they will deny any wrong doing not matter what evidence is brought forth.

    I didn't comment on the morality of it, I merely pointed out the flaw in your example.
    There are numerous arguments, for both sides that have yet to be made. I don't really care either way, my account's not on Xbox.
    My response to your analogy was 100% accurate.

    Not on XBOX but the way I see it, if I go on Amazon and steam gift cards are listed 2 bucks a pop instead of 20. Im gonna buy a shipload. If I check plane tickets and theyre listed 30 bucks instead of 300, guess im taking 10 extra trips. If I see something on a digital marketplace is listed as cheap as humanly possible? I WILL BUY IT. Forget all that garbage about common decency. I swear im tired of you self righteous people calling this an exploit. People are cheap, money is a limited resource. You never disrespect a fire sale you just abide by it. I wouldn't be thinking "oh no i could get banned for properly purchasing this item off the marketplace ". Id be thinking "oh crap Daybreak is blessing the gang with the ill discount". Of course now that I know this event happened ill be wary of it going forward, but don't disrespect people who don't look a gift horse in the mouth. This isn't like some infinite selling glitch, it was a legitimate item on the marketplace with no clear information telling you it shouldn't be that price.

    It's funny you mention "common decency" in such a negative light, because common decency is the reason a lot of Xbox players aren't biting the dust right now. The majority of people getting banned was not banned due to the Marketplace purchases.

    This is not true. In the UK, in retail, you cannot amend the price at point of sale without justification. You cannot refuse to transact with any individual without reason.

    In practice you can do all of these things. But the consumer has the right to challenge you legally and you must justify your actions. All items sold by a retailer must have a sale price or RRP. If something is incorrectly labelled they can change it to the correct price, but if the sale price is visible and not incorrect as to the RRP it cannot be changed at point of sale. We have very robust consumer laws to ensure consumers are protected from unfair treatment by retailers, which also includes not being served without justification. You do not have to justify your actions to the consumer at the given time, but you will have to justify it legally, this protection comes form the UK equality act. The laws get messy depending on how big or small your company is, but in general what you said is over generalised and not entirely accurate.

    Exactly, all the people crying that they got banned for buying stuff that was under-priced have simply forgotten something else they did wrong, which is the thing that got them banned.

    I’m going to clear this up right now, I’m sick and tired of all the accusations and speculations made on this thread, none of you were effected and don’t have a clue what actually happen, I was effect an I was given my account back so let me make this very clear, the Xbox players that were ban were Mistakenly Ban, here is the proof an email I received from daybreak - “I am the Manager responsible for watching after DC Universe Online. This is a notification to let you know that we have looked into the recent action taken against your account, and we have reversed said action.

    There was a recent sweep done to find accounts abusing a current exploit to duplicate items. Through the course of this investigation, some accounts were unintentionally included due to multiple purchases of a Starter Pack made while the pricing was set incorrectly. This incident has now correctly been excluded from the scope of this current exploit.

    Your account has been released and should be available to login. We apologize for the confusion.” alright case closed, also to further elaborate, the sale happened on a weekday morning right after maintenance an lasted only afew hours therefore most people weren’t on when it happened. So throw out your common decency theories out the window all there people that were on that morning did participate and were complicit just like any other sale just the other day legend characters were 1$ on market place, originally 10$. I would like to request this thread be closed because most of these comments are speculative and full of slander. Thank you

    With all that said I say congrats to the people that came up and got what they needed. Most of the people talking high and mighty in this thread would have done the same thing and told people as well. So again Congrats to all that got what they needed.

    Can you please link me to the relevant sections of the Consumer Rights Act 2015 that demonstrates my characterisation of a trader’s rights is not entirely accurate?

    I worked for one of the UK’s largest retailers, a FTSE 100 company, between 2001 and 2010, so I’d be happy to see where the law has changed in these areas.

    I don’t think it would negate the point that the poster I replied to was fundamentally wrong to say retailers have to honour a published price, but still.
